What does outsourced HR actually include?

Our outsourced HR service acts as your complete HR department. This includes drafting and maintaining employment contracts, company handbooks and workplace policies; managing disciplinary, grievance and absence procedures; advising on redundancy, restructuring and TUPE transfers; providing day-to-day telephone and email HR advice; supporting recruitment processes; and keeping you updated on legislative changes that affect your business.

Do I legally need employment contracts for my staff?

Yes. Under the Employment Rights Act 1996, every employee and worker must receive a written statement of employment particulars on or before their first day of work. This must include key terms such as pay, hours, holiday entitlement, notice periods, job title and place of work. Failure to provide this is a breach of employment law and can result in an additional award of two to four weeks' pay at an employment tribunal.

How do I handle a disciplinary correctly?

You must follow the ACAS Code of Practice on Disciplinary and Grievance Procedures. This means conducting a fair investigation, notifying the employee of the allegations in writing, holding a formal hearing where the employee can be accompanied, making a reasoned decision, confirming the outcome in writing, and offering the right of appeal. What is TUPE and when does it apply?

TUPE (Transfer of Undertakings Protection of Employment Regulations 2006) protects employees when a business or part of a business transfers to a new employer, or when a service provision changes (such as outsourcing, insourcing or retendering a contract). Employees transfer automatically on their existing terms and conditions. Both the outgoing and incoming employer have legal obligations regarding consultation, employee liability information and protection against dismissal connected to the transfer.
